Family Arbitration is another form of Dispute Resolution offered by 1KBW in financial and children law cases, conducted in accordance with the rules of the Institute of Family Law Arbitrators. In a family arbitration, the parties appoint an arbitrator to determine a dispute on such terms as they may agree: for example, they may require that the arbitrator hears evidence, or determines the dispute on paper. The arbitrator prepares a written decision (‘the Award’) which, save in exceptional cases, will be made into a court order on an expedited basis (S v S [2014] EWHC 7 (Fam)).
The family law arbitration process affords complete privacy and allows for disputes to be resolved quickly, and without the delays and uncertainty of litigation.

We presently have eleven members of chambers who are Finance Arbitrators and six who are Children Arbitrators, all of whom are Members of the Chartered Institute of Arbitrators, and many of whom also sit as part-time judges. 1KBW can also accommodate the arbitration within our London based chambers.
