On 25 June 2021 the Court of Appeal handed down judgment in a complex matter concerning the transitional provisions of the Maintenance Regulation and the ambit of FPR 4.1(6), in the context of an order resulting from a mistaken application under BIIA, which should have been made under the Maintenance Regulation, in relation to the attempted recognition and enforcement of the financial aspects of a French order.
